Newsletter on Changes to the Exemption Criteria for Registration in the Data Controller Registry
As per the decision published in the Official Gazette on 25.07.2023 by the Personal Data Protection Authority (“Board”), a change has been made in the criteria regarding the exception from the obligation to register in the Data Controllers’ Registry (“Registry”).
In this context, the limit regarding the annual financial balance sheet total, “natural or legal person data controllers whose annual number of employees is less than 50 and whose annual financial balance sheet total is less than 25 million Turkish Liras, whose main field of activity is not processing sensitive personal data”, which is stated in the Board decision dated 19.07.2018 and numbered 2018/87, has been increased.
The exception mentioned within the scope of the update has been changed to “natural or legal person data controllers whose annual number of employees is less than 50 and whose annual financial balance sheet total is less than 100 million Turkish Liras, whose main field of activity is not processing sensitive personal data“.
